Terms of Service

These Terms of Service ("Terms") govern your use of the Freely Given mobile application and website (collectively, the "Service") operated by Freely Given ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, downloading the app, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Freely Given.

We reserve the right to update these Terms at any time. Material changes will be communicated through an in-app notification or email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Account Terms

  • You must be at least 13 years of age to create an account and use the Service.
  • You are responsible for maintaining the security of your account and password. Freely Given is not liable for any loss or damage resulting from your failure to protect your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You may not use the Service for any illegal or unauthorized purpose.
  • You must provide a valid email address to complete the registration process.
  • A single person or entity may not maintain more than one free account.

3. Subscription Terms

Free Plan

The free plan provides access to core features with certain usage limits (e.g., 15 Bible questions per week). The free plan is available indefinitely at no cost.

Premium Plan

The Premium plan provides access to all features, including 20 Bible questions per day, Focus Mode, all reading plans, and advanced highlights and notes. Premium is available as a monthly subscription ($4.99/mo) or yearly subscription ($39.99/yr).

Auto-Renewal

Premium subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Renewal charges are processed through your app store (Apple App Store or Google Play Store) at the rate of your current plan.

Cancellation

You may cancel your Premium subscription at any time through your device's app store. Upon cancellation, you will retain access to Premium features through the end of your current billing period. After that, your account will revert to the free plan. Canceling does not entitle you to a prorated refund for the remaining time in your billing period.

Refunds

All subscription purchases are processed through the Apple App Store or Google Play Store. Refund requests are subject to the refund policies of the respective app store. We do not process refunds directly. If you believe you were charged in error, please contact your app store or reach out to us at [email protected] for assistance.

Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance, and existing subscribers will be given notice before the new price takes effect on their next renewal.

4. Content Ownership

Your Content

You retain ownership of any content you create within the Service, including bookmarks, highlights, notes, and questions you submit. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

Our Content

The Freely Given app, website, branding, and original content (excluding Bible text and AI-generated responses) are the intellectual property of Freely Given. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

Bible Text

Bible text displayed in the app is sourced from publicly available translations and is used in accordance with their respective copyright and usage terms.

5. AI-Generated Content Disclaimer

Freely Given uses artificial intelligence (powered by Anthropic's language models) to generate responses to your Bible questions, daily devotionals, and other content within the app. You acknowledge and agree that:

  • AI content is not infallible. While we strive for accuracy, AI-generated responses may occasionally contain errors, misinterpretations, or incomplete information. Always verify important theological points against Scripture and consult trusted pastors or scholars for significant spiritual decisions.
  • AI content is not pastoral counsel. Freely Given is a study tool, not a substitute for personal pastoral care, professional counseling, or community worship. We encourage you to use Freely Given alongside — not in place of — your local church and faith community.
  • AI content may vary. Responses may differ each time you ask the same question. This is a characteristic of AI language models and does not indicate an error.
  • We are not responsible for decisions made based on AI content. You are solely responsible for how you use and act upon information provided by the Service.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Harass, abuse, or harm another person, or promote violence or discrimination.
  • Attempt to gain unauthorized access to the Service, other user accounts, or related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use automated tools (bots, scrapers, etc.) to access the Service without our written permission.
  • Reproduce, duplicate, or resell any part of the Service.
  • Use the AI chat feature to generate content that is hateful, obscene, or intentionally misleading.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Freely Given and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Freely Given and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the Service or violation of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, unless you are in a jurisdiction that grants you the right to bring claims in a local court.

10. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify you through the Service or by email. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes.
